EEOC Adopts Final Rule on GINA Recordkeeping Requirements
Effective April 3, 2012 the Equal Employment Opportunity Commission (EEOC) has amended the current Title VII and Americans with Disabilities Act (ADA) recordkeeping regulations to include references to the Genetic Information Nondiscrimination Act (GINA). Under these requirements all covered entities must preserve all employment and personnel records that they make or keep for a specified period and preserve all records relevant to a Title VII, ADA, or GINA-related charge until the charge is resolved. The rule does not require the employer to create any documents or meet any reporting requirements.
