Car Dealership’s Sales to Vulnerable Adult Not Covered Under E/O Policy

A South Carolina Court granted an insurer’s motion for summary judgment for coverage of claims arising from a car dealer selling cars to a woman with diminished capacity.  The woman’s legal guardian brought suit against the car dealership for selling the woman large numbers of cars for herself and others alleging claims such as exploitation, conversion and conspiracy, among others. The court agreed with the insurer that the acts alleged were intentional and therefore did not fall within the bounds of the policy.
