EPL ALERT: Class Action Sent Back to State Court After Federal Overstepping
June 16, 2011-In considering consolidated claims against Baycol alleging injuries suffered by West Virginia plaintiffs, the Court ruled that a federal court lacked authority to bar a state-court class action. A federal court in Minnesota had denied class certification, then enjoined a separate Baycol class action pending in state court in West Virginia. The top court held that the federal court had exceeded its authority under the Anti-Injunction Act.
