EPL ALERT: Dismissal Affirmed in Ongoing-Running Class Action Against AT&T on Pension Plan

Third Circuit - New Jersey - June 22, 2011. A class of almost 24,000 current and former employees of AT&T have lost their battle over the management of the company's retirement plan.  The employees contended that AT&T violated the Employee Retirement Income Security Act (ERISA) when it converted their pension plan to a cash balance plan. The plaintiffs also alleged that the changes disproportionately harmed older employees in violation of the Age Discrimination in Employment Act (ADEA).  The court didn't buy plaintiffs' claims under the application of either statute and allowed dismissal to stand.
