“Second Mile” D&O and EPL Insurer Must Defend Sandusky, For Now

The Middle District of Pennsylvania ruled that Gerald A “Jerry” Sandusky does not need to be indemnified under D &O and EPL policies issued by Federal Insurance Company to the Second Mile.  Sandusky is the now infamous founder of the Second Mile, a charity organization for underprivileged Pennsylvania children, and former assistant coach at Penn State who has been charged with sexually abusing a number of children over his career.  The Court determined that indemnification for the sexual abuse allegations would go against public policy. However, in light of the current lack of discovery, Federal Insurance must continue to defend Sandusky for now.
