A Wolf in Sheep’s Clothing: Professional Negligence Claims Disguised as Ordinary Negligence

Plaintiffs have started to disguise professional negligence claims as ordinary negligence as an attempt to avoid the higher expert standards and affidavit of merit requirements applicable to professional negligence claims in many jurisdictions. This presentation will include examples of those attempts and a discussion of strategies for responding to require that plaintiffs meet the procedural requirements applicable in professional liability claims.
About the Speaker

Kevin McCarthy focuses his practice in the areas of professional liability, product liability, and catastrophic personal injury, as well as insurance matters, such as coverage disputes and claims of bad faith.
Kevin holds leadership roles in both the Minnesota Defense Lawyers Association, where he serves on the Events Committee, and in the Defense Research Institute, where he is the acting Chair of the Young Lawyers Seminar Planning Subcommittee. Kevin graduated summa cum laude from Michigan State University College of Law, where he was the class salutatorian, }nishing second in his class.
During his undergrad studies at Lehigh University in Pennsylvania, Kevin played NCAA Division I varsity basketball and rowed for the varsity crew team. He was also an active member of the Student Athlete Council.
Outside of his practice, Kevin enjoys visiting his hometown of Detroit, Michigan, and spending time outdoors hunting and fishing.
